Understanding Traffic Violations in Maryland

Traffic violations refer to a wide range of offenses that occur while operating a motor vehicle. Under Maryland law, thy can encompass a variety of offenses ranging from minor infractions such as parking violations to more severe charges like hit-and-run incidents.

It's also important to distinguish between moving violations and non-moving violations, as their penalties vary. Moving violations occur when a vehicle is in motion and usually involve the driver committing an unsafe or illegal action while driving. Common examples of moving violations include speeding, running red lights, DUI, and reckless driving. These types of offenses tend to carry more severe consequences as they pose a higher risk to public safety and are more likely to result in accidents or injuries.

On the other hand, non-moving violations typically occur when a vehicle is stationary or parked. These violations do not directly involve the vehicle being driven in an unsafe manner but may still result in fines or penalties. Examples of non-moving violations include parking infractions, expired registration or inspection stickers, and equipment violations such as a broken taillight. While these offenses are generally considered less serious than moving violations, repeated non-moving violations can still lead to increased penalties, including higher insurance rates and potential impact on your driving record.

Each type of violation carries its specific set of penalties, which might include expensive fines, points on your driving record, increased insurance rates, and even potential jail time for the most serious offenses.

The Point System in Maryland

Maryland employs a point system to monitor and regulate driver behavior on the road. When a driver is convicted of certain traffic violations, points are added to their driving record by the Maryland Motor Vehicle Administration (MVA).

The number of points assigned depends on the severity of the offense. For example, minor infractions like failing to stop at a red light might result in a few points, whereas more severe violations such as DUI can lead to substantially more points.

Protect Your Right to Drive

Common low-point traffic violations include:

  • Failing to use a turn signal.

  • Not turning in a “turn only” lane.

  • Certain speeding tickets (depending on how much you exceeded the posted limit).

Higher-point violations are more severe and include:

  • Driving under the influence of alcohol or drugs (DUI).

  • Unlawful use of your MD driver's license.

  • Loaning or borrowing a driver's license.

Accumulating points can snowball into several adverse effects. If you accumulate 8 or more points within a two-year period, their license may be suspended. Accumulating 12 or more points can result in a revocation of the driver's license.

Points remain on your record for two years from the date of the violation, affecting insurance rates and the ability to maintain a clean driving record.

Maryland drivers must be mindful of this system and aim to keep points to a minimum to avoid these serious repercussions.

Points and Their Consequences

3 to 4 Points: If you accumulate 3 to 4 points, the MVA will send you a warning letter. This is an early alert to help you adjust your driving habits before facing more severe penalties.

5 to 7 Points: Reaching 5 to 7 points means the MVA will require you to enroll in a Driver Improvement Program (DIP). This program is designed to educate drivers on safe driving practices and help prevent further violations.

8 to 11 Points: With 8 to 11 points, the situation becomes more serious. The MVA will issue a notice of suspension. You can either accept the suspension or request a hearing within 15 days from the notice date. Accepting the suspension requires you to return your last issued driver's license to the MVA before the suspension date shown on your notice. If you request a hearing, your suspension will be held in abeyance until the hearing is completed.

12 or More Points: Accumulating 12 or more points leads to a notice of revocation. Like a suspension, you can accept the revocation or request a hearing within 15 days of the notice date.

If you receive a notice of suspension or revocation, we urge you to take prompt action. If you would like to request a hearing to show cause why the revocation should not be imposed, you must complete and return the notice, along with the filing fee, within 15 days from the notice date.

Failing to do so can result in automatic penalties that may affect your ability to drive and maintain your daily freedoms and responsibilities, like driving your children to school or getting to work on time.

An Overview of DUI in Maryland

Driving under the influence (DUI) is one of the most serious traffic violations in Maryland and carries severe penalties. Maryland law defines DUI as operating a vehicle with a blood alcohol concentration (BAC) of 0.08% or higher.

A first-time DUI offense can result in up to one year in jail, a fine of up to $1,000, and a six-month license suspension. Subsequent offenses carry harsher penalties, including longer jail time, higher fines, and extended license suspension periods.

Understanding the full scope of DUI laws and potential defenses can make a significant difference in how your case is resolved.
